Taylor Ridge man claiming he was hit by garbage truck sues County Waste, driver

A Taylor Ridge man is suing County Waste Systems Inc., of Rock Island County, and one of its drivers, claiming he was severely injured after being hit by a garbage truck in May.
Donald E. Shaver is seeking more than $50,000 in damages in the complaint filed on Monday in Rock Island County Circuit Court against County Waste and its drivers, Randall H. Cain, of Davenport.
The suit claims on May 26, Mr. Cain was driving a garbage truck north on 7th Street in East Moline when he ran a red light at 16th Avenue and tried to turn the wrong way onto a one-way street, colliding with Mr. Cain, who was westbound on 16th Avenue.
Mr. Cain sustained "serious injuries," including myofascial strain, neck and lower back pain, and his wife, Shannon I. Shaver -- also listed as a defendant -- lost spousal consortium because of her husband's accident.
"Randall H. Cain was unqualified, negligent and careless in the operation of his garbage truck," and County Waste should not have entrusted its truck to him, the complaint contends.It also claims County Waste should have properly trained its driver and is liable for any injuries caused by an employee's negligence.
A representative from County Waste could not be reached for comment on Tuesday. A May 16 case management conference is scheduled for the case.
